1 Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of ENERGYYA's solar-powered charging stations, website at energyya.com.ng and energyya.org, and any related services (collectively, the "Services") operated by 386konsult Energy Limited, a 386Holdings Company ("ENERGYYA", "we", "us", or "our").

By accessing or using our Services, you confirm that you are at least 13 years of age and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use of our Services immediately.

2 Our Services

ENERGYYA provides solar-powered mobile charging stations deployed in communities, markets, campuses, and off-grid areas across Nigeria. Our services include:

Device charging via solar-powered kiosks
Secure Wi-Fi access at charging locations
Covered co-working spaces with surveillance
Deployable stations for events and emergency power needs

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

3 Acceptable Use

When using our Services, you agree not to:

Damage, tamper with, or attempt to interfere with any ENERGYYA equipment
Use our stations for any unlawful purpose or in violation of any regulations
Attempt to disrupt or overload our infrastructure or networks
Harass, threaten, or harm other users at our charging locations
Use our Wi-Fi to transmit malicious software or engage in illegal activity
Reproduce, duplicate, or resell any part of our Services without written permission

ENERGYYA reserves the right to deny service or access to any individual who violates these acceptable use standards.

4 Intellectual Property

The ENERGYYA name, logo, website, and all related content, features, and functionality are owned by 386konsult Energy Limited and are protected by Nigerian and international copyright, trademark, and other intellectual property laws.

You may not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, or transfer our intellectual property without our express written permission.

5 Limitation of Liability

To the maximum extent permitted by applicable law, ENERGYYA and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or damage to devices — arising from your use of our Services.

Our Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding reliability, availability, or suitability for a particular purpose.

ENERGYYA is not responsible for damage to devices caused by use of our charging stations. Users charge at their own risk.

6 Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason — including if you breach these Terms.

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

7 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.

8 Changes to Terms

We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. We encourage you to review these Terms periodically.

Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
